Full payment is required before any hosting service is rendered, which includes renewals. trP Servers utilizes both an automated billing system and pay as you go. Billing commences on the date that you sign up. trP Servers does not prorate server costs, if you order on a certain day of the month, your following bill will be the same day the next month. All subsequent payments will occur on the day of the month of the anniversary of the billing cycle. Billing will continue until you cancel your hosting account and cancel your paypal subscription for those of you who set up subscriptions. All monetary transactions are in $US dollars. Additional features can be added at any time. trP Servers reserves the right to amend its prices at any time.
All clients reserve the right to cancel at anytime. As a policy, we do not offer credits or refunds for hosting time already expended (48 Hours after initial purchase). This only applies to cancellation by the client. If cancellation is done by trP Servers due to restrictions violation, there will be no refund. trP Servers will only allow for the discount if cancellation is not the fault of the client, as determined by trP Servers.
To cancel your account, please login to your paypal account. Next, under “My Account” find any recent transaction to
sales@trpservers.com. Click on the “Details” of the transaction, and then click the reference number. Now scroll down and click “Cancel Subscription” and confirm the cancelation.
Indemnification Policy:
You agree to use all trP Servers services and facilities at your own risk. trP Servers specifically disclaims all warranties of merchantability and fitness for a particular purpose. In no event shall trP Servers be liable for any loss, or loss of data, or other commercial damage, including but not limited to special, incidental, consequential or other damages. Customer agrees that it shall defend, indemnify, save and hold trP Servers harmless from any and all demands, liabilities, losses, costs and claims, including reasonable attorney's fees asserted against trP Servers, its agents, its customers, officers and employees, that may arise or result from any service provided or performed or agreed to be performed or any product sold by customer, it's agents, employees or assigns.
Customer agrees to defend, indemnify and hold harmless trP Servers against liabilities arising out of:
- Any injury to person or property caused by any products sold or otherwise distributed in connection with trP Servers’ server(s);
- Any material supplied by customer infringing or allegedly infringing on the proprietary rights of a third party;
- Copyright infringement;
- Any defective products sold to customer from trP Servers' server(s).
trP Servers shall be the sole judge of what violates this Policy.
Server Abuse Policy:
If we determine that any client on our servers is using too much of the server's resources and therefore abusing the server, we have the right to suspend that client and his/her subscription without any notice. It is then up to you to contact us and formulate a plan to get the server activated again. We are quick to suspend any clients that abuse the server's resources due to the shared nature of the server and the negative impact an abusing client has on other clients and their servers. Clients who attempt to utilize server products that are not fully paid for will receive cancellation of server promptly with no chance of refund. trP Servers reserves the right to make all judgments on the literature of exactly that and is the sole arbiter in determining violations of this provision.
Content Policy:
All services provided by trP Servers may be used for lawful purposes only. Transmission, storage, or presentation of any information, data or material in violation of any United States Federal, State, City or municipal law is prohibited. This includes, but is not limited to: copyrighted material, trademark, intellectual property, material we judge to be threatening or obscene, or material protected by trade secret and other statute without proper authorization. The subscriber agrees to indemnify and hold harmless trP Servers and its associates from any claims resulting from the use of the service which damages the subscriber or any other party. trP Servers will be the sole arbiter as to what constitutes a violation of this provision.
Server Policy:
We reserve the right to refuse service to anyone for any reason not prohibited by law, including the right to terminate service to any customer for any reason not prohibited by law. Any deliberate attempt to cause damage to trP Servers or any other Internet servers will result in immediate account deactivation without prior notice. No refund is given in this case. Full backups are made weekly. No guarantees are made of any kind, either expressed or implied, as to the integrity of these backups. Backups are made for server restoration purposes only. It is the client's responsibility to maintain local copies of their server content and files. trP Servers is not responsible for loss of server files. Servers do face hardware and software issues like any computer, this alone exonerates trP Servers from financial responsibilities to recoup and losses that clients may have in regards to their server(s). trP Servers reserves the right to shut down servers for server maintenance and move server IPs at any point in time. To assure our customers, trP Servers will only do this knowing that the server is not in use at the time of service.
Support Policy:
It is the client's responsibility to have a good working knowledge of aspects of their server’s files and operation. trP Servers support staff will attempt in all its efforts to help and teach our clients on how to use aspects of the server tools. At any point in time we encourage our clients to utilize our ticket support system, Live Chat, and even mIRC; all of which can be found on our website at www.trpservers.com
trP Servers reserves the right to amend our Terms and Conditions at any time and without notice.
You agree to be bound by these Terms and Conditions upon ordering anything from trP Servers.
